Outdoor storage facilities for electricity, heat, and hydrogen will also be given priority in the future

With the Fourth Act Amending Energy Industry Law, which contains a total of 29 articles amending various laws, the Bundestag also passed an amendment to Section 35 of the Building Code on November 13. It expands the list of privileged construction projects in outdoor areas to include the sub-daily storage of heat and hydrogen and the storage of electrical energy in a battery storage facility with a storage capacity of at least 1 megawatt hour.

Furthermore, the recommendation for a decision further emphasized the “overriding public interest in facilities for storing electrical energy” already enshrined in Section 11c of the Energy Industry Act (EnWG). It now adds: “Until the electricity supply in Germany is virtually greenhouse gas-neutral, the accelerated expansion of energy storage facilities should be included as a priority concern in the respective weighing of protected interests.”
